Permitted Use Terms

Definitions

Application means a software product that obtains data via an interface with the CCC Secure Share™ Network and that is approved by CCC. All Applications shall be hosted on servers that physically reside in the United States.

Affiliate Application means another Application owned by you, or an Application wholly owned and operated by your wholly-owned subsidiary or parent entity of which you are a wholly-owned subsidiary.

Third Party Application means an Application other than your Applications and Affiliate Applications.

Data means the information sent from the CCC Secure Share™ Network directly, or via an Affiliate or a Third Party, to your Application. All Data shall exclusively be stored in and accessible from the United States.

Permitted Use Terms
  • Access to the Data, whether received via the CCC Secure Share™ Network directly or from an Affiliate or a Third Party, shall:
    • be solely for (a) the purpose of you providing your Application to your customers, which shall consist of repair facilities, repair facility networks, insurance companies, independent appraisers, automobile OEMs, materials and parts manufacturers and distributors, and/or rental car companies (each a “Customer”) and (b) the purpose of providing Data to Affiliates or Third Parties subject to and in accordance with the terms of the Application Registration Agreement and these Permitted Use Terms
    • be available to you, and not to any third party or the general public
    • along with EMS, be your sole source of the Data from CCC products and services
  • You agree not to use or permit the use of the Data for the following purposes:
    • any use outside of, or beyond, the principal purpose of the Application Type under which the Application was registered
    • consumer credit reporting
    • pricing insurance policies
    • motor vehicle history reporting
    • publishing for public consumption
    • use by any party except your Customer(s) in their use of your Application, and use by Affiliates and Third Parties that receive Data from your Application subject to and in accordance with the terms of the Application Registration Agreement and these Permitted Use Terms
    • comparison of CCC sourced data, CCC products and CCC services, including but not limited to the estimate costing, labor times, and parts pricing Data therein, to those of CCC's competitors in the provision of auto physical damage estimating products and services
    • directly or indirectly, reverse engineer or otherwise attempt to construct (through compilation or otherwise) a collision estimating database, parts catalog or price list, or to create any database of the same
    • to disparage or otherwise harm CCC, its customers or their customers
    • transformation of the Data into CIECA EMS format
    • to present to any third party the Data in repair estimate form
    • any use not permitted under your agreement with any Customer
  • You agree to delete any Data accessed or received under this Agreement for a Customer within 90 days after termination of this Agreement, or either the termination your Customer's subscription to the Application or authorization to grant you access to the Data for that Customer.
